Thank you. Um, so I don't know about all you guys. Well, I do know that some of you's got a lot of calls about dangerous trees that aren't on city property. They keep telling me over and over that Rome has an ordinance, why can't we do it? So I had Marcus print me Rome's ordinance. He talked to the Codes Department out in Rome. I talked to Councilperson, Commissioner Sokolowski about it. And what I want to do in this discussion is to touch on aspects why we can do this, if why we can't do it. Um, I, I also invited Parks Commissioner Short because he is our arborist, but it doesn't look like he's coming. I didn't hear back from him. So, um, I'll just open it up to, um, Marques, if you want to start. We worked on this, so you know more Sure. The positives, and then I'll let legal go in and discuss it and what Mark's done. What I could just tell you about this right off the bat, there's a couple good things that they do right off the bat. Obviously our tree department, I think, what do we have, 2 or 4 guys?

3, okay. Obviously we have a hard enough time getting trees down that need to come down. So they would not be able to do this. This would be something where, um, a tree would be deemed dangerous and the person's house, the person who owns the tree, um, would respon— be responsible to take it down. If they did not take it down, we would hire an outside person and they would be billed for it. The problem right off the bat is in Rome, I think they have 120,000 put into their budget for this type thing. Am I correct, Marcus?

And then they also have a professional arborist, right, that can go and say if it's dangerous or not. This legislation, a lot of it opens up— their legislation, I don't know how they do it, but to me it opens up a lot of cans of worms for lawsuits for the city. But I just wanted to discuss all of it before I wrote a piece of legislation and it couldn't go anywhere. So I'll open it up to you, and then, Steph, you jump in. You guys all jump in.

And I also just took, um, at a couple— just a couple locations, um, of pictures of what I was trying to explain. Uh, they're not the best pictures, but, um, I've talked to each one of you guys, or for the most part, and I believe all of you have the same issues in your district. I know last time when we brought this up they started talking about like tractor-trailer cabs and all that, and which, which would be a nuisance to if somebody was there next door to them. But I wasn't, um, that's not what I was talking about. That's not where my complaints have been. My complaints have been mostly, you can see by the pictures, where you have people operating businesses out of their house, where they have multiple trailers, multiple you know, pay loaders, plows. The one place in North Utica, they actually were next to the woods, and nobody really knows who owned the property. They took it upon themselves to cut trees down and move all the property and move the vehicles over there. And I've had multiple complaints. I talked to Marcus. When codes would go there, they would come back and tell me— Marcus would come back and tell me that there's really nothing that they can do about it. I know like last year on Lorraine Ave, we had a guy bought a bus and it sat there for, I'm pretty sure it's gone now, sat there for almost a year while he was remodeling it. Just stuff like that. I know I talked to you, Joe, you have the same issue. Talked to Bob, you had the issue. So it's just something, and we're not here, Marcus will speak of it too, we're not really here to go— for these codes guys to go out and look for all problems. It's more or less the people that are nuisance when there's a problem, they have something to help us out with. So that's what I'm trying to do. So, Marques, you want to talk on it?

And the other thing that I talked about last, last time, kind of like when we— when they come in front of the zoning board, 4-foot fence is the minimum. But some people want a 6-foot fence, and they come and give their case. So if there is a complaint, and the guy— let's say, for example, it's summertime, a guy's got a food truck, and there's a complaint, somebody's really complaining, making a big thing— they could come up and we can amend that to give that guy a permit to do that. So again, it's not to try to hurt anybody, it's to try to help these guys. I just got frustrated when you call. And all of you guys probably do the same thing. You call up and they send codes there and you say, what happened? And they say, there's nothing, nothing, it's nothing in there we can do.

See, my biggest concern, like something like that, if a guy's driving a tow truck and he comes home and he's leaving home 7 o'clock and he's leaving at 6 in the morning, that's one thing. My biggest concern was multiple, multiple vehicles in areas, you know what I'm saying?

Um, we, we ended up turning that appeal process into the council can just pass to allow it because the council is the one that's closest to the people.

So when this all started back, I grew up '74, '75. The way it worked at the Parkway, everybody, you got a pass. Most parents bought you a season pass for Christmas. And back then, it was over $100. Okay, so I'm not— I'm just telling you, that's what we need to do is not worry about your day pass or your 4-hour pass. You need to come up with a way to buy a week pass where somebody gets a deal, or a season pass. But if you could see what's going on right now, we're in February, we just got all the water and everything done for snowmaking, and we're trying to get this opened as soon as possible. So maybe we do something for rates for this year and then see where we go. But the way it works, the way most people who are going to use that— their parents are going to buy the kids a season pass, just the way Judge, just the way Valley View, most of the people buy a season youth pass at Valley View. So it's the same type thing. So that's, that's just right.

Yes, and I'm going to let Marcus talk to us. So this is basically just helping our Codes Department to give them some teeth on, uh, problems. So I've been having a lot of issues where people are calling me, uh, one specific area on Riverside Drive where, um, you know, a resident cut a bunch of trees down, has 7 or 8 big large trucks there. And, um, so I, I talked to Marcus every time they send people there, and it's not just this property, it's all over where people are bringing dump trucks home, um, taking— buying a bus. Um, we have a place on, uh, Lorain Ave where a person has a bus that they bought a bus and they're redoing it into a camper. Um, and when we send our codes there, there's nothing in codes. So I've gone to Marcus, uh, he's been extremely helpful. I'll let him— he helped me draw this up and I'll let him speak on this a little bit. And the only thing I do want to say about this, I'd like— we're in the next month or so, we're going to have a lot of stuff going on. To bring this out for a vote tonight, it has to be unanimous. I'd like to, you know, I'd like to get this done and pass it. It's, um, you know, I did my homework, I worked with the Codes Department, and it's something I think it benefits all the residents of the city. The one thing I want to say beforehand, if anybody's listening, you know, we have, we have a code that you have to have 4-foot fencing. There's a lot of people that will come in front of the zoning that they have a 6-foot fence, and if they have a reason, it gets sent that they can, you know, if it's proper, they can put the fence up. The same thing with this. If somebody has a food truck that's parked on the side of their house that is not being, you know, a deterrent to the neighborhood or making things bad, they are able to get a special permit to be able to do that. This is basically to stop, you know, what's going on in a lot of places— people running businesses out of their house with large vehicles. And guess what? All of you guys sitting around here, you all have people in your, in your districts doing the same thing. So I'll let Marcus speak on this, and I have another piece, um, after, um, kind of the same type thing, um, and I'll let him talk on that too.

What, what I'm more against is a place on Lorraine Ave that, you know, we've had a problem where a guy's got a school bus that's been there for 6 months that he's redoing it. Okay, huh? On the dead end, that type of stuff. We know that codes guy, if somebody's off the road coming over the road and is there a night, even 2 nights, codes guy is— isn't— most of the time the neighbors aren't calling. It's for the other stuff that happens daily. I mean, it's— there's a lot of stuff that— you know what, I have a very nice district. And I'm proud of it, and I'm proud to represent my people. And people who take care of their properties shouldn't have to go through this and, and see this— a guy that is, uh, you know, a contractor and has 3 or 4 trucks there and is parked on the grass. That's, that's what we're at. Obviously, we don't want to hurt anybody's business and, you know, hurt anybody, but I'm just telling you, it's an issue. And all— every one of you guys and I'm sure of it, has got calls about this in our district.

This is basically for people who just fill their front yards with— I don't want to say garbage or debris. I'll give you an example. People have garage sale and they have a ton of stuff, and the stuff doesn't go away, and they just move it to their front yard. And it's, you know, I don't want to use the word garbage or trash, but it's just a nuisance to the neighbors who keep their properties in good order. And when we send codes there, I mean, I could send you— if we, uh, you know, if we do have to have a committee meeting, I will bring you pictures in. But, um, it's just, it's just something that it's very uncomfortable to the people who live around that, that have to see that. All the time. And again, I'll let Marques speak on that. And listen, the reason of these two pieces of ordinance, the reason I have them is when I call codes and they agree with me 100% when they go and see the issues, but they tell me there's nothing in the law that they can do to help out. So that's why I've got with Marques and, um, came up with something.

I've had some discussions with my colleagues here on this. We all seen what we did during the budget season. We all agree that I think, you know, if there's a— I've been in favor of the committee system from the beginning, and we never had the votes to pass it. I think that when we've seen how it worked, I think everybody kind of agrees that you should have some sort of a committee system. That's just my opinion. And the other thing is I know there was talk that— I don't know if it was amended before in these rules. I would like to make sure that we don't have where there has to be a piece of legislation before we could call a meeting, because, I mean, I— not that I got burned, but a couple of times I just wanted to have a meeting and I took, you know, something from Herkimer on the homeless and different stuff, and it comes out that I you know, was all in favor of that when I just wanted to have a meeting to see what we could do, um, to try to fix it. So is, is that in these rules? Because that's one thing I would like amended about— we can have a meeting at any time that doesn't have to have— it doesn't— you don't have to have legislation and committee to call a meeting.
